1. Introduction

1.1 Parties

These Terms of Service (“Terms”) constitute a binding agreement between you (“you,” “your,” or “Player”) and The Aquarium poker club (“we,” “us,” “our,” or “the Club”), operated by Mike Bell. These Terms govern your access to and use of the website theaquarium.poker and The Aquarium poker club on ClubGG (Club ID: 813885).

1.2 Global Service

The Aquarium is a global online service. We provide our Website and Club services to players worldwide on a uniform basis, wherever ClubGG is available. We are not established in, and do not target, any single jurisdiction. By using our services, you acknowledge that you are responsible for ensuring your use complies with any local laws applicable to you.

1.3 Acceptance

By accessing the Website or joining the Club on ClubGG, you agree to be bound by these Terms. If you do not agree, do not use our services.

2. Description of Services

2.1 The Website

The Website provides information about The Aquarium poker club, including rake structure and comparison, how to join on ClubGG, frequently asked questions, blog articles about poker, and contact information. The Website does not facilitate any financial transactions.

2.2 The Club

The Aquarium operates a private poker club on the ClubGG platform (Club ID: 813885), offering NLH, PLO4, and PLO5 at $0.25/$0.50 and $0.50/$1.00 stakes with 3% rake capped at $1 per hand.

2.3 ClubGG Platform

All gameplay occurs on the ClubGG platform. Your use of ClubGG is governed by ClubGG's own Terms of Service and policies. The Aquarium operates within and complies with ClubGG's rules for private clubs.

3. Eligibility

By using our services, you represent that you are at least 18 years of age, not located in a jurisdiction where accessing online poker clubs is prohibited, and not using our services in violation of any applicable laws. You are solely responsible for determining whether your use of our services is legal in your jurisdiction.

4. Deposits and Withdrawals

All deposits and withdrawals are conducted exclusively via cryptocurrency, primarily USDC/USDT on Solana, Tron, Ethereum, MultiversX, Base, BNB chain, Arbitrum, Polygon, and Near protocol. All financial transactions are conducted directly between you and the club owner (Mike Bell). The Club does not charge deposit or withdrawal fees. Players are responsible for any blockchain network transaction fees.

5. Rake and Fees

The Club charges a flat 3% rake capped at $1 per hand. There are no membership fees, no withdrawal fees, no agent commissions, and no minimum deposit requirements aside from what you wish to play with.

6. Player Conduct

Players must play fairly, not engage in collusion or cheating, not use bots or automated software, respect other players, and follow ClubGG's Terms of Service. We reserve the right to remove any player and withhold funds in cases of fraud or prohibited activities.

7. Intellectual Property

All content on the Website is the property of The Aquarium and protected by applicable intellectual property laws. The Aquarium name, logo, and branding are proprietary.

8. Disclaimer of Warranties

The Website and Club services are provided “as is.” We do not guarantee uninterrupted access to games, specific game availability, or the continued availability of the ClubGG platform. We are not responsible for third-party platforms including ClubGG, Telegram, X, or cryptocurrency networks.

9. Limitation of Liability

To the maximum extent permitted by applicable law, The Aquarium and Mike Bell shall not be liable for any indirect or consequential damages. Poker involves both skill and chance — we do not guarantee any specific financial results from gameplay.

10. Indemnification

You agree to indemnify The Aquarium and Mike Bell from any claims arising from your violation of these Terms, your use of the Website or Club services, or your violation of applicable laws.

11. Modification of Terms

We reserve the right to modify these Terms at any time. Your continued use after changes are posted constitutes acceptance.

12. Governing Provisions

The Aquarium operates as a global online service available wherever ClubGG operates. Any disputes shall first be addressed through direct communication with the club owner via Telegram (@mike3000) or email (info@theaquarium.poker). We aim to resolve all disputes fairly and directly.
